HORTON: Thank you, Members. 10 Please, let's call the Property Tax 11 Committee to order. 12 We would ask the staff introduce themselves 13 for the record, and present the one item that's 14 before us. 15 MR. YEUNG: Hello, Property Tax Committee 16 Chairman Horton and Committee Members of the Board. 17 My name is David Yeung, Chief of the 18 County-Assessed Properties Division. I -- with me 19 is Lisa Thompson. 20 I bring before you today three Welfare 21 Exemption Claim forms for your consideration. 22 It has been the Board's long-standing 23 position that both the owner and operator of 24 property seeking a Welfare Exemption apply and be 25 granted an Organizational Clearance Certificate. 26 Recently, the Second District Court of 27 Appeals decided that an operator of property does 28 not need to file a Welfare Exemption Claim. The 3 1 forms before you reflect that change. 2 The first two are revisions to existing 3 forms to reflect that the operator no longer need to 4 apply for an exemption. 5 The third is a new form asking the owner of 6 the property to certify the use of the property. 7 The revisions and the new form were developed 8 through the interested parties process involving 9 industry representatives and assessors. 10 As a consequence, we believe there are no 11 unresolved issues remaining. 12 I'm available to answer any questions you 13 may have, and to ask for the adoption of these 14 forms. 15 MR. HORTON: Thank you very much. 16 Members, this brings the Board of 17 Equalization's practice in compliance with the 18 holdings in the Jewish Committee Center development 19 decision made by the Courts. But it also, I 20 believe, string lines the process and brings a 21 little equity to the Welfare Exemption process. 22 In the past, the property owner would have 23 to have a Welfare Exemption, and then all of the 24 participants would also have to have a Welfare 25 Exemption. It just made it relatively complicated. 26 And this simplifies it, streamlines it, 27 accelerates the process so that those who are doing 28 nonprofit work and that have a facility where others 4 1 are within that facility can continue to do the good 2 work that they -- they are currently doing. 3 Respectfully ask for a motion on this. 4 MS.
